These General Conditions of Sale are concluded between on the one hand CLAUDIE FERRÉ, (hereinafter referred to as “the Company”) registered with the RCS of Versailles under Siret number 82501052300025, having its registered office at 46 Avenue du Lac 78121 Crespières, and on the other hand, any person having made a purchase on the site www.claudieferre.com, hereinafter referred to as “the Customer”. Any purchase on the site www.claudieferre.com automatically implies acceptance of all of these conditions, which the Customer acknowledges having read before placing his order.

The website accessible at the address “www.claudieferre.com” (hereinafter referred to as “the Site”) enables CLAUDIE FERRÉ to offer vintage, design and antiques items for sale.

The site also allows appointments to be made online via the wordpress form or by mail / tel accessible at the address “https://www.claudieferre.com/contact-v2-map/” in order to benefit from a visit to the showroom.

 

Article 1: Declaration of the buyer

The Customer who purchases on the site declares:

If he is a natural person, be an adult and be legally capable of contracting under the General Conditions of Sale;

If it is a legal person, that the person placing the order on behalf of the Buyer has all the powers of representation and commitment to place the order in the name and on behalf of the Buyer;

That the purchase of products on the Site is made for strictly personal use and without direct or indirect connection with a professional activity

 

Article 2: Price

All prices presented on the Site are inclusive of all taxes (TTC). Product prices are indicated in euros and do not include shipping costs invoiced in addition to the price of products purchased depending on the geographical area of ​​delivery and the total amount of the order. The shipping costs will be indicated before the final validation of the order by the Buyer.

 

CLAUDIE FERRÉ reserves the right to modify its prices without notice and the prices applied to the Customer correspond to those displayed on the site at the time of his order.

The goods remain the full property of CLAUDIE FERRÉ until receipt of the total amount due paid by the Customer.

 

Article 3: Presentation of articles

CLAUDIE FERRÉ strives to present and describe its items available for sale as precisely and accurately as possible. In accordance with Article L. 111-1 of the Consumer Code, the Buyer may, prior to his order, find out on the Site of the essential characteristics of the product (s) he wishes to order.

 

Article 4: Order

Product selection and order validation

The Customer, when browsing the Site, can add Products to his virtual basket. He can then access the summary of his virtual basket in order to confirm the Products he wishes to order by pressing the “view basket” button and place his Order by pressing the “confirm order” button.

The Customer must provide an address, a delivery method as well as a valid payment method in order to finalize the Order and effectively form the sales contract between him and the Company CLAUDIE FERRÉ. The order is validated once the payment has been accepted by the Company. The Company reserves the right to refuse an order if the Customer already presents a dispute with the Company or if the Company considers that the Customer carries a risk of default of payment.

The Company undertakes to fulfill orders within the limits of available stocks. In the event that the products prove to be permanently unavailable, CLAUDIE FERRÉ will inform the Customer by mentioning a “sold” badge or a “reserved” badge. In the event of a cancellation due to temporary or permanent unavailability of products, the Company undertakes to reimburse the Customer as soon as possible.

Once the order has been validated, the Customer will receive confirmation by email. This confirmation will summarize the Order as well as relevant information relating to the delivery.

 

Create an account

When placing an order, the Customer must create a personal account which includes the following personal data:

email (used for sending an order confirmation);

first and last name ;

delivery address (including postcode, city and country);

phone number.

 

When creating a personal account, the customer receives an email from the Company confirming his registration. He can then identify himself by entering his password (determined beforehand when creating the personal account and known to the Customer only). The password is strictly personal and confidential. The Company recommends that anyone

having created a personal account on the Site to regularly change his password and choose complex passwords including letters, capitals, numbers and specific characters. Customers with a personal account are responsible for the loss or theft of their password. However, the Customer also has the possibility of placing an order on the Site without the obligation to create a personal account. Delivery methods Before proceeding with payment, the Customer must complete the billing information and delivery information and then choose the shipping methods.

 

The Customer will have the choice between the following means depending on the destination:

As from their validation, the invoicing and delivery information will be considered as final by the Company CLAUDIE FERRÉ and cannot be modified. Payment for products may be made by any means of payment offered via the Site. The Customer should refer to Article 5 of these General Conditions of Sale for more details on this subject.

 

Article 5: payment The different payment methods Once the Customer validates his order, he accepts all of the General Conditions of Sale. The online store on the Site does not allow payments in several installments. 3D Secure payment The Customer’s order may be subject to 3D Secure verification. 3D Secure is a payment system by authentication which guarantees the Customer optimum security when making online purchases. During payment, the cardholder’s bank verifies his identity in order to validate the transaction. How a 3D Secure verification works: After validating their bank details, the Customer is transferred to their bank’s website. In the 3D Secure window that appears, the authentication process to follow is specific to each bank.

The Customer may be asked:

Enter your date of birth;

To enter a code received by SMS;

To answer a personal question.

This exchange of information between the Client and his bank is secure. It guarantees the identity of the card user. For any question about the 3D Secure code (obtaining, losing, modifying, etc.), the Customer must contact his bank directly. CAUTION: After 3 authentication failures, the transaction is canceled. Secure payment – Protection of banking transactions

 

The CLAUDIE FERRÉ Company entrusts the security of its transactions to the Stripe service provider. Payment is secure thanks to the online payment system of our partner Stripe. Bank data only circulates on the Internet in encrypted form, that is to say, they are encoded in such a way as to make them completely illegible and are therefore never kept by the Company.

 

Article 6: Delivery and reception Terms and conditions

 

The Products are delivered exclusively in: France, Europe, United Kingdom, America to the address provided by the Customer when placing the Order. For other countries, please contact Claudie Ferré in advance.

 

Delivery delay

The Company undertakes to make its best efforts to deliver the products ordered by the Customer as soon as possible, these deadlines being communicated for information only. Delivery times may vary depending on the destination. The Company cannot be held responsible for any delays in delivery. Shipping cost The delivery costs depend on the delivery method chosen by the customer and calculated on the entire order. Claim

The Customer is required to check the condition of the Products delivered. He has a period of fourteen (14) days from delivery to formulate any reservations or complaints for non-compliance or apparent defect of the products delivered, with all the relevant supporting documents. After this period and failing to comply with these formalities, the Products will be deemed to comply and free from any apparent defect and no complaint can be validly accepted by the Company.

 

Article 7: Transfer of Ownership – Transfer of Risks The transfer of ownership of the Company’s products, to the benefit of the Customer, will only be carried out after full payment of the price by the latter, regardless of the date of delivery of said Products. In accordance with Article L. 216-4 of the Consumer Code, regardless of the date of transfer of ownership of the Products, the transfer of the risks of loss and deterioration will take effect as soon as the Customer takes physical possession of the Products or as soon as support by the carrier. The Products therefore travel at the risk and peril of the Company when it comes to delivery.

 

Article 8: Nullity and independence of clauses If one or more stipulations of these General Conditions of Sale were declared invalid in application of a law or regulation or a final court decision, the other stipulations would remain in force and scope.
